Você já ouviu os termos “timeshare”, “multipropriedade” ou “propriedade compartilhada”, mas não consegue entender muito sobre o assunto?

Recentemente fiz uma entrevista com a Maya Garcia, advogada e especialista em time share, em que conversamos sobre o assunto e ela esclareceu as principais dúvidas a respeito dessa nova tendência do mercado imobiliário aqui no Brasil. Confira a entrevista:

Edgar Ueda: Multipropriedade e propriedade compartilhada são mesma coisa?

Maya Garcia: Na verdade assim existe uma interpretação semântica e uma interpretação mercadológica.

Quando a gente fala em time share a gente basicamente está falando em divisão em tempo compartilhado. A multipropriedade que é, ou seja, quando a pessoa tem o título da propriedade, mas de uma maneira fracionada, ela não deixa de ser também um time share, porque ela é, na verdade, a espécime de um gênero maior.

A diferença é que no mercado as duas nomenclaturas começaram a batizar negócios diferentes. Então o time share, ele é uma divisão no tempo, quando a pessoa não tem propriedade e a multipropriedade como o próprio nome diz é quando a pessoa tem o título, mas são negócios muito diferentes, o timeshare ele acaba sendo convertido as diárias em pontos em diárias, em sorteio em reservas. Como a propriedade ela se mantém em uma cadeia hoteleira e você só compra um direito de uso. Ela tem um leque um pouco maior de como você pode organizar, porque é o próprio gestor hoteleiro que vai determinar as regras de uso dessas unidades para quem quiser adquirir.

Então, você pode ter desde aquele timshare clássico, daquele que se vende 10 anos, 15 anos, 30 anos de uso como timeshare um pouco mais flexíveis em que a pessoa adquire um conjunto de pontos que ela pode converter em diárias ou ela pode adquirir diárias já pré programadas. Enquanto que a multipropriedade, não.

A multipropriedade, ela tem um título de propriedade, isso dá uma segurança maior. Você é um pouco mais restrito nessa liberdade, porque sendo o proprietário ele não pode ser alijado de alguns direitos que são inerentes à propriedade.

Os dois negócios são extremamente lucrativos, eles são extremamente inteligentes, mas eles têm suas peculiaridades diferentes. Geralmente quem é desenvolvedor de multipropriedade, ele não é desenvolvedor de timeshare, são dois negócios que são muito semelhantes mas eles têm as suas especificidades que os diferenciam bem, inclusive nos desenvolvedores em cada um.

Edgar Ueda: A pessoa que desenvolve o time share necessariamente está atrelada à propriedade compartilhada?

Maya Garcia: É, a ideia do timeshare é a pessoa que desenvolve, ou seja, a pessoa que é dona do empreendimento, ela não quer se desfazer do empreendimento. O máximo que ela vai fazer é vender direitos de uso dessas unidades por um período. Uma vez finalizado esse período essa propriedade está voltando para esse empreendedor.

Quem está vendendo ali é lógico que vai ter uma boa administradora, uma boa gestora de tempo compartilhado, mas a ideia da multipropriedade é o incorporador desenvolver, vender e sair do negócio.

O desenvolvedor do timeshare nunca sai do negócio, porque o empreendimento nunca deixa de ser dele, ele só está temporariamente permitindo o uso desse empreendimento para esses adquirentes.

Então, muito cliente meu chega para mim e fala: “Maya, o que eu desenvolvo, desenvolvo timeshare ou multipropriedade”. E aí eu sempre brinco: “isso tudo vai depender de qual que é o papel que você quer ter. Você quer um papel apenas de um incorporador ou você quer ser um gestor deste empreendimento coordenando esta carteira, gerindo essa carteira até o final?”.

Quando a pessoa tem uma inclinação, um perfil de realmente “não, eu não sou um gestor de um empreendimento. Eu prefiro realmente incorporar e sair”. Evidentemente o perfil é muito mais de multipropriedade, mas quando a pessoa fala “não, o negócio é meu. Eu não quero vender, eu quero explorá-lo de uma maneira um pouco mais inteligente através do compartilhamento”. Aí o perfil sem dúvida é de timeshare.

Edgar Ueda: Onde surgiu essa modalidade e como que chegou até o Brasil?

Maya Garcia: É um pouco a história do nosso DNA. A multipropriedade, na verdade, ela surgiu na França diferentemente do que as pessoas acham, ela não é um modelo americano, ela é um modelo francês. Ela surgiu após a Segunda Guerra como uma maneira de acesso ao crédito imobiliário. Então, a Europa estava muito devastada muito machucada pela guerra. As pessoas não tinham capital livre. E aí que se surgiu a ideia da multipropriedade como um acesso mais fácil a um imóvel.

Então a ideia inicial foi francesa, toda a ideia do bussiness e do compartilhamento. Mas os americanos pegaram essa ideia e transformaram essa ideia obviamente de uma maneira um pouco mais profissional e ampliaram isso em uma escala obviamente muito maior. Então, quando a gente acha que o timeshare e a multipropriedade, elas são americanas é porque foi nos Estados Unidos onde existiu o grande boom desses negócios.

O grande mercado é americano. Eu acho que a multipropriedade e o timeshare fazem muito parte da cultura americana.

A gente chegou a um índice muito interessante no ano de 2000, 6% da população americana tinha pelo menos uma propriedade em multipropriedade e timeshare. Quando a gente fala 6% de um país de 350 milhões de habitantes, a gente está falando de um número bastante expressivo.

No Brasil se chegou através da minha família que meu pai vendo que isso era um negócio muito inteligente. Ele veio introduzir essa ideia na América Latina. E aí ele prospectou o Brasil prospectou terras no Chile, Argentina, no Uruguai e havia sido escolhido Argentina. Mas aí eu resolvi, nasci no Brasil. Nessa não deu para programar, minha mãe veio grávida o Brasil. Resolvi nascer no Brasil e aí com toda essa questão pessoal, o primeiro empreendimento de multipropriedade da América do Sul acabou sendo no Brasil especificamente no litoral norte de São Paulo. Esse empreendimento existe até hoje, ele é o mais antigo do Brasil e faz aproximadamente três a quatro semanas ele foi também nomeado como empreendimento mais longevo do mundo. Longevo no sentido de várias gerações se sobrepondo no mesmo empreendimento e ainda é existente até hoje.

Edgar Ueda: Não só os Estados Unidos, América Central, México é muito forte nesse tema também e as grandes escolas estão praticamente lá. Por que o Brasil ainda não pegou tração nessa modalidade? Existe uma cultura adaptado ou não aceita por que que está travando essa evolução?

Maya Garcia: O México sempre foi a nossa grande referência, vamos dizer assim, porque é um país latino americano e ao mesmo tempo nosso grande concorrente.

Então, por exemplo, quando a gente tinha eventos há 15 anos para angariar investidores internacionais, o Brasil sempre perdia para o México e óbvio o México onde é que teve a facilidade mexicana? Eles são muito próximos dos Estados Unidos. Então basicamente o que é que acontece? Eles tiveram uma facilidade porque o próprio público americano que queria usufruir de férias no México já trazia essa cultura. Então ele já era um público mais preparado, mais acostumado. O cara que comprava um timeshare ou uma multipropriedade em Cancún, por exemplo, ele já era um americano.

Ele já era multiproprietário preparado. Ele já era um proprietário que já via isso no país dele, então, ele já não tinha dificuldades com os contratos, ele já era vamos ter assim um amasiado, e ele já era um consumidor amasiado. Não à toa o México teve as leis de multipropriedade e elas foram muito mais antigas do que a nossa. Então, o México que não foi bobo nem nada já fez uma lei, já criou isso no ordenamento jurídico deles e isso dava uma segurança jurídica na aquisição desses empreendimentos muito maior. Potencial turístico, eles têm, mas eu não elejo como um diferencial, porque eu acho que o Brasil tem um potencial turístico igual. Eu acho que a gente não perde nesse sentido. Não foi um fator relevante. Eu faço, por exemplo, muita multipropriedade nas Filipinas e as Filipinas têm um potencial turístico fantástico, é um país que tem sete mil ilhas, tem ilhas até desertas, mas sofre muito com o que o Brasil sofre, falta de regulamentação legal.

A dificuldade de o juiz entender o que é um negócio, dificuldade do próprio público consumidor entender o que é o negócio.

Primeiro, foi a demora em a gente ter uma lei. A lei trouxe uma segurança jurídica mínima, de isso existir, de estar previsto no ordenamento, de um judiciário poder entender o que é isso porque já existe uma previsão do cartório não poder negar um registro, porque já existe uma previsão.

Então, eu acho que a demora em a gente fazer a lei foi, sem dúvida, uma coisa que foi colocando o Brasil um pouco para trás, sem lei e sem segurança jurídica você não atrai o investidor.
